Re: Mediation as the only civilised responsible way
ahead
Dear Dr. Biester,
the legal proceedings in regards to access between the children J-M Hickman
and S. Hickman illegally relocated to Germany and their foreign left behind
father have stalled due to many reasons. The chief thereof being the total
inadequacy and German National bias of the German Judiciary, in particular
the District court of Wilhelmshaven, to deal with such complicated international
cases in a neutral unbiased and non racial manner. As you are well
aware a particular brand of German Nationalism has become a significant issue
in this case, which you in your political position in the justicial controlling
body at the state government level and as participant in the current proceedings
you are more than well aware of. In fact the current legal proceedings
are little more than a judicial circus at this moment in time, this is
a truly dark incident in the history of modern Germany in the year 2004,
a truly shocking state of affairs when one considers that two young children
are being abused, their basic human and legal rights are being violated by
the very authorities and institutions who are responsible to ensure the best
interests of the children. This is being done in the name of German Nationalism.
As no one else has shown the leadership, courage or responsibility towards
the affected children to do something about the matter I hereby take the
lead and appeal to you to use your considerable influence and commanding
position in this matter to find an acceptable and just solution to the issues
at hand.
I therefore approach you as a responsible and just politician who sits on
the judicial controlling body of the government of Lower Saxony and attorney
of law who takes his elected position in the state government and his position
of attorney representing the German abducting parent with the seriousness
that both deserve. I request you to propose a meeting of both sides to attempt
to find a common solution to this barbaric and unacceptable state of affairs
in which the basic human rights of more that one of the parties are being
massively violated by the German state apparatus. I propose to you that both
parties sit around a table at a neutral venue to discuss the problem in depth
and to seek solutions to resolve the issues in a civilised adult manner,
in a manner one would expect from all the parties to this issue in a civilised
Germany in the year 2004.
As the wellbeing and the further violation of two young children hinges on
your positive response to this proposal and appeal from me I would appreciate
a response from you as soon as is possible. I certainly do not have to
inform you of the importance to the wellbeing of the children concerned in
finding an acceptable and lasting solution to these violations of their basic
human rights as soon as may be practical.
Last but not least I have approached the children’s uncle Bruce Hickman who
is a very experienced jurist with experience as a senior lecturer of law,
at the law school of the University of Natal and as a judge assessor in the
South African Supreme Court as well as experience in New Zealand as lecturer
of law and as an attorney of law, for him to consider acting as a mediator
between the parties if my efforts and my appeal to you fails to get an audience
or a satisfactory response.
